This Privacy Declaration describes the way in which AVA Clinic, Medical Care, collects, maintains and treats information about individual people who visit this site.

BY USING THIS WEBSITE, YOU AGREE TO THE COLLECTION AND USE OF DATA AS SET OUT IN THIS PRIVACY POLICY. YOU ALSO RECOGNISE THAT AVA CLINIC MAY CHANGE PERIODICALLY, MODIFY, ADD OR REMOVE OR, IN ANOTHER WAY, UPDATE THIS PRIVACY POLICY WITHOUT PREVIOUS NOTIFICATION. However, we will always treat your personal information in accordance with the Privacy Policy that was in place at the time of collection. It is our intention to publish changes to the Privacy Policy on this page, so that you are fully informed about the type of information we collect, how we use it and under what circumstances it can be disclosed. The Privacy Policy is located on our homepage and also on any page where Personal Data is requested. At these data collection points, an additional explanation may be provided, where appropriate, as to the purpose for which the data will be used.

1. Privacy Commitment

The term “Personal Data”, as used in this Privacy Policy, refers to information such as your name, date of birth, gender, e-mail address, mailing address or phone number that can be used to identify you. We will only process your personal data as described in this Privacy Policy. Nevertheless, we reserve the right to carry out further processing in the extent permitted or required by law, or via any legal or criminal investigation.

The next sections explain how and when do we collect your personal data.

2. Targeted use of personal data

Most of our websites do not require any kind of registration, allowing the user to visit our website without letting us know who you are. However, some services may require the user to provide us with personal data. In these situations, if you choose to retain any personal data requested by us, you may not be able to consult some parts of the website and we may not be able to respond to your requests.

3. Non-disclosure of personal data

AVA Clinic will not sell, share or distribute your personal data to third parties, except in accordance with this Privacy Policy. Your Personal Data can also be transferred to third parties (subcontracted) that act on our behalf, for additional processing according to the purpose(s) for which the data were originally collected. These third parties have contracted with AVA Clinic the exclusive use of the Personal Data for the agreed purpose, and will not sell your Personal Information to third parties or disclose it to third parties, except as required by law, as permitted by us or by third parties as declared in this Privacy Policy.

The Personal Data collected can also be transferred to a third party, if the business of this website or part of it is sold, assigned or transferred, in which case we will require the buyer to process Personal Data in accordance with this Privacy Policy. In addition, Personal Data may be disclosed to third parties if we are obliged to do so due to a law, judicial order or government regulation, or if such disclosure is necessary to support any legal or criminal investigation in Portugal or abroad.

4. Right of access, rectification, opposition, limitation and erasing

Right to access

At any time, the data subject has the right to obtain from AVA Clinic confirmation that the personal data that relate to him are processed or not. Also, the data subject has the right to access its data and the following information:

(a) the purposes of the processing;

(b) the categories of personal data;

(c) the recipients or categories of personal data recipients;

(d) the time limit for the storage of personal data or the criteria to be used to define it;

(e) the rights conferred to the data holder under the GDPR;

(f) the right to submit a complaint to a control authority;

(g) the origin of the personal data.

Right to rectify

The data subject has the right to obtain from AVA Clinic the rectification of any inaccurate personal data, as well as the right to complete data that are incomplete.

AVA Clinic shall communicate the rectification of data to third parties to whom the personal data has been transmitted, unless such communication is impossible or implies a disproportionate effort.

Right to portability

AVA Clinic ensures that, when the processing of personal data is based on the consent of the subject or on the performance of a contract, and is carried out by automated means, the data subject has the right to:

(a) receive the personal data that has been provided and processed, in a structured format, of current and automatic reading (ex: database copy, CSV, etc);

(b) transmit this data to another processing responsible.

Right to opposition

The data subject has the right, at any time, to oppose to the processing of their data, for reasons related to their particular situation.

Right to limitation of treatment

The data subject has the right to request AVA Clinic to limit the processing of their personal data in certain situations such as:

When the subject disputes the accuracy of their data, the limitation of the processing shall apply during the period necessary to verification;

The processing of the data is illicit and the data subject is opposed to its erasing, requesting instead the limitation of the processing;

When personal data are no longer necessary for the purposes of processing, but are required by the data subject for the purpose of declaring, exercising or defending a right in a judicial process.

When a subject is opposed to the processing of his personal data, it should be limited until it is found that the legitimate reasons for the treatment responsible prevail over the ones of the data subject.

In other words, the limitation is the suspension of some data processing activities, and may be temporary and/or a limited to specific to a scope of processing (ex. not getting emails in the context of marketing actions).

Right to erasure (or “be forgotten”)

The data subjects may request that their data be completely deleted, without undue delay, and, in this sense, AVA Clinic should erase it.

This right may only be granted to the subject in the following situations:

Their personal data are no longer necessary for the purpose that motivated the collection or processing;

The personal data subject withdrew the consent on which the processing of personal data is based, and there is no other legal basis that justifies the processing of the personal data;

The subject exercises the right of opposition to the processing of their personal data, for reasons related to their particular situation, when the basis of lawfulness is the legitimate interest of the company, provided that there are no other prevailing and legitimate reasons;

The subject exercises the right of opposition to the processing, when their personal data are processed for direct marketing purposes;

There is a legal obligation for the erasing of personal data;

When the storage period for the data has been exceeded.

However, AVA Clinic should not defer the erasing when the processing of the data reveals itself necessary:

In the fulfilment of a legal obligation requiring the processing, foregone by an European Union right or a Member State to which AVA Clinic is subjected;

In the performance of public interest functions or the in the exercise of public authority that the controller of personal data is invested;

For the purpose of declaration, exercise or defending a right in a judicial process.

5. Security and confidentiality

To ensure the security and confidentiality of the Personal Data we collect, we use protected data networks. In the course of the processing of your Personal Data, we take reasonably planned measures to protect this information against loss, misuse, unauthorised access, disclosure, change or destruction.

6. “Cookies” and internet tags

We can collect and process information about your visit to our websites, such as the pages you visit, the website where you came from and some of the research that you perform. Such information is used to help improve the content of the site and compile aggregated statistics on the use of our website for internal market research purposes. By doing this, we can install “cookies” that collect the username, internet service providers, operating system and the date and time of access.
